Senator wants investigation into Feds’ lack of access to Enrique Marquez day after San Bernardino mass shooting
A Wisconsin senator is alleging that federal investigators were prevented from possibly arresting Enrique Marquez Jr. in connection with the San Bernardino terrorist attack the day after the mass shooting.
Shortly after the attack, law enforcement identified Marquez of Riverside as the person who purchased the two rifles used in the attack.
Ron Johnson, chairman of the Senate Committee on Homeland Security and Governmental Affairs, has asked the Inspector General of the Department of Homeland Security to investigate the incident, which he said was brought to the committee’s attention by whistleblowers.
Johnson, R-Wisconsin, said during a committee hearing Tuesday that Marquez and his wife, Mariya Chernykh, were scheduled to meet with U.S. Citizenship and Immigration Services in San Bernardino at noon Dec. 3. The FBI notified Homeland Security Investigations — which is under the U.S. Immigration and Customs Enforcement — and requested they send a team of armed agents to arrest Marquez.
But when they arrived, USCIS officials would not let the agents into the building nor were they allowed access to Chernykh’s file, according to Johnson.
“If accurate, these accounts reveal an alarming lack of coordination between DHS components in the wake of the deadliest terrorist attack on American soil since 9/11,” Johnson said in a letter sent Wednesday to Inspector General John Roth. “A complete and thorough investigation of this incident is warranted to identify failures in coordination and to implement procedures that allow for the free flow of information in the wake of potential future terrorist attacks.”
Johnson said USCIS officials denied agents’ request for Chernykh’s A-file and instead allowed them to take a photo of her picture in the file.
Marquez and Chernykh failed to appear for their scheduled meeting with USCIS, and HSI did not receive Chernykh’s full file until Dec. 10 — one week after the incident, Johnson says in the letter.
The couple was scheduled to meet with immigration officials about their marriage, but the couple never showed and their request was denied, according to the Dec. 17 criminal compliant filed against Marquez.
On Dec. 2, Syed Farook and his wife, Tashfeen Malik, killed 14 people and wounded 22 others during a shooting at the Inland Regional Center in San Bernardino.
Marquez is chargedwith conspiring with Farook to provide material support to terrorists; lying about the purchase of two assault rifles — a 5.56-caliber Smith and Wesson, model M&P-15 Sport, and a 5.56-caliber DPMS, model A-15 — that Farook and Malik, used in the shootings; marriage fraud; and making a false statement on immigration paperwork regarding the sham marriage.
Marquez has pleaded not-guilty to the charges.
Marquez entered the UCLA Harbor Medical Center emergency room on Dec. 3. Hospital personnel say Marquez appeared to be very anxious. He was later placed on an involuntary hold, according to court documents.
According to an emailed statement from the Department of Homeland Security on Wednesday, the HSI agents informed USCIS that they wanted to question a person of interest who had a previously scheduled appointment at a local USCIS field office.
“After receiving supervisory concurrence, the USCIS field office director provided HSI special agents access to the USCIS office to facilitate the questioning of the person of interest. However, the individual did not appear for the appointment. USCIS then provided HSI access to the information contained in the file related to that person of interest,” according to the statement.
ICE and USCIS recognize the importance of close cooperation and coordination between the two agencies in circumstances with potential national security implications and USCIS’ Records Operations Handbook specifically addresses protocols for the expedited sharing of information in such situations, according to the statement.
In this case, the request made by the HSI agents fell outside of USCIS’ protocols and policies governing the routine use of USCIS facilities by federal, state and local law enforcement agencies, according to a DHS official. Guidance was sought and promptly received that was appropriate to the circumstances, according to the official’s statement.
During Tuesday’s hearing — on the security of U.S. Visa Programs — Johnson questioned USCIS Director Leon Rodriguez and ICE Director Sarah Saldaña about the incident.
“So we had a team armed up, potentially dealing with a terrorist. They had a tip from the FBI that Mr. Marquez might be at the USCIS office and the officer in charge of the USCIS office wouldn’t allow HSI into the building and wouldn’t give them the A-file,” Johnson said during Tuesday’s hearing. “That’s not indicating a great deal of cooperation between two different agencies under DHS whose supposedly top concern is security of this nation.”
Rodriguez said when Homeland Security agents arrived to the USCIS office in San Bernardino, field leadership consulted with higher ranking officials who instructed them to assist.
“Unfortunately it all happened so quickly that it was incorrectly perceived that our folks were trying in some way to object to what (HSI) was trying to do,” he said. “Do we need to look at our protocols to make sure those misunderstandings don’t occur? That may well be something we need to do, but there was never an actual intention to prevent them from doing what they needed to do.”
Johnson is asking Roth, who also spoke during Tuesday’s hearing, to look into why USCIS officials blocked agents from entering the San Bernardino office and accessing Chernykh’s file; to confirm when HSI received all relevant immigration materials from USCIS related to Marquez and Chernykh; when USCIS and HSI agents became aware that Marquez and his wife were not going to appear for their appointment; whether any DHS protocols were violated that day and what implications this incident had on Marquez’s apprehension and charges as well as on the investigation into the attack.
He asked that Roth provide appropriate recommendations on how DHS, ICE and USCIS can improve their operations to prevent a reoccurrence of the Dec. 3 incident.
He also asked that Roth ensure that the whistleblowers are not retaliated against by agency management.
Johnson also sent a letter Wednesday to Jeh Johnson, secretary of the Department of Homeland Security, outlining his concern that ICE management has been seeking to identify and retaliate against the whistleblowers.
“I respectfully request that you immediately direct ICE to cease all efforts of retaliation for communications with the committee and strongly discipline any employees who have taken such actions,” according to Johnson’s letter to the DHS secretary.
